Ekaterina A. Belokrylova LEGAL AND EDUCATIONAL FACTORS FOR CREATION AND IMPLEMENTATION OF STATE POLICY IN THE SPHERE OF ENVIRONMENTAL SAFETY REGULATION IN THE RUSSIAN FEDERATION

Humanity inhabits are approaching an ongoing decaying world due to an increasing environmental crisis which is being inevitably converted into the crisis of the entire civilization. The main characteristics of the mentioned crisis might be a violation of the ecological balance all over the planet and the rapidly occurred amount of environmental safety risks caused by the anthropogenic activities in various fields of the industrial sectors.

The provision of environmental safety of any state and society depends on numerous reasons in the field of politics, economics and the social life; however, the most important ones are legal regulation and education.

According to the Environmental Doctrine of the Russian Federation, which was approved by the Russian Government Direction from the 31st of August 2002 #1225-p, the higher-priority aspects of the policy in environmental safety sphere have been established for the long term. It is worth highlighting that the foundation of the mentioned policy is the Sustainable Development Concept, which directly corresponds with the guaranteeing of sufficient quality of life, health and national safety along with simultaneous conservation of eco-systems and the harmonic conditions of the ambient environment support.

Unfortunately, those regulations have only the declarative character due to the lack of any established obligations and legal responsibility to fulfill them.

The Federal Environmental Act of Russia from the 10th of January 2002 # 7-FZ ensures the key environmental rights in the Environmental Safety such as: the right to get access to improve an education and culture in the environmental sphere. The essential attention should be drawn to the growth of the educational level, professional skills and knowledge in the Environmental Law and Policy.

Therefore, the state politics realization in the environmental safety ought to be guaranteed by, first of all, the availability of high-skilled competent specialists and, second of all, reasonable and adequate legal regulation of environmental protection and human health.

In addition, emphasizing the previous point, it is vitally necessary to create the favorable legal conditions for ecological enlightenment all the concerned parties and progressively increase the quantity of high expertise people in any areas of the environmental safety.

The qualitative preparation of specialist-ecologist during the contemporary stage of the environmental development of Russia has to be the priority task. Considering the complicated situation either in Russian Federation or in the world in general there is an obvious and logical necessity to educate specialists who will possess profound ecological knowledge.

The remarkable fact, which took place in Udmurt State University in 2000, connected with the mentioned points has been reflected for the first time in Russia by implementing the unique innovative educational system of training high-skilled specialists in the Environmental Law and Policy. This educational system has been introduced as the separate division of Institute of Law which until nowadays has no analogue in the entire country. The principal aim is to prepare of lawyers-ecologists in the process of legal regulation and policy in the environmental protection and safety.

The academic specialists of Institute of Law have created 15 studying modules and among of them the most significant are: “Environmental Law and Policy”, “Comparative Environmental Law and Policy”, “Legal Regulation of Environmental Safety”, “International Environmental Law”, “Environmental Law and Policy of European Union” and others.

Learning those subjects provides the preparation of high-qualified specialists – lawyers who possess fundamental environmental knowledge with the ability to interpret and apply the legal norms in environmental protection and safety areas.

Nowadays in the world of globalization and creation of the united educational space a lawyer-ecologist should have enough expertise in the International and European environmental law and also use those skills in transboundary conflicts in order to provide the environmental safety and stability in all worldwide levels.

Making a conclusion, the dominant author’s position of the current abstract is that the legal and educational factors in training of broad spectrum specialists plays the important role in preventing the global environmental crisis in general and will become the strong “catalyst” of the Sustainable Development Concept implementation.
