CONSIDERING PECULIARITIES OF RUSSIAN LEGISLATION BEFORE LAUNCHING WASTE TREATMENT INVESTMENT PROJECTS

Russian regions including Nizhegorodskaya oblast are on the way to improve waste management. Concept of regional target programme on waste management was adopted in 2008. The title of the programme is “The development of waste treatment system for Nizhegorodskaya oblast for 2009-2014”. Key element of successful implementation of the programme is improvement of it’s force of attraction to investors. Waste economics should become profitable cluster of economics in the region. Private business is ready to invest on the basis of state support. Foreign investors are concerned to participate in waste management projects in the Russian regions. But sometimes they meet insurmountable handicap generated by Russian federal legislation ruining hopes on successful development of waste cluster.

Three points are important for investors.

First, guarantee confirmation of waste flow stability to landfills and waste treatment plants is lacked because Russian regional authority have no rights to manage waste flows especially for inter-municipal landfills and plants.

Second, significant handicap in development of waste management system is generated by lack of indispensable enforcement to enter in agreement on waste transportation and waste treatment for several groups of waste generators. The result is that millions ton of wastes are disposed without payment and license.

Third, household payments for municipal services include payments for waste transportation and disposal. The payments are coming from households to private company providing municipal cervices. State or municipality are not involved in waste disposal agreements and payment regulations.

European experience differs from Russian one. No direct agreements between households and waste disposal operators exist. Key body of the scheme in EU is municipality. Households are paying to municipalities for transportation and disposal of wastes. Municipalities have possibility to select waste operating company inviting them to operate with guaranteed waste flow. It improves force of attraction to investors. European good practice is important for Russian regions.

Implementation of Russian regional waste projects needs improvement of federal legislation and broad use of European good practices.
